TELECOM SERVICE PROVIDERS AND THEIR LEGAL LIABILITY – AN INDIAN OVERVIEW
India has seen remarkable advancement in the adoption and usage of mobile technologies. More and more Indians are leapfrogging to adoption of mobile devices. Consequently, the telecommunications networks in the country are becoming extremely robust. Further, these telecom networks are being targeted by a variety of telecom service providers for the purposes of providing various services on such telecom and mobile networks. However, these telecom service providers in India have a distinct legal liability under the existing Indian Cyberlaw. This is so because these telecom service providers are all coming within the ambit of the intermediaries under the Indian Information Technology Act, 2000.
Further, the law has straddled the said telecom service providers with the mandatory responsibility of exercising due diligence while discharging their obligations under the law. The Indian Cyberlaw takes a strict view of telecom service providers who do not comply with the law. Commission of offences or contraventions by companies acting as telecom services providers under the Information Technology Act, 2000 does lead to its own stringent consequences.
